My concern is that this instates an individualist romantic author at the centre of European Union copyright law and thus is likely to marginalise collaborative, improvised and spontaneous creativity. I don’t think there is any doubt that football watchers would call Bergkamp the author of that goal. Was the move ‘pre-conceived’?
