January 20, 2022 12:26 pmI agree Josh. “Back in the Day” prior to AIA, there was always some measure of risk of a given patent being invalidated in Court, but it seems that after AIA, given the stats. on the number of events averse to patent owner, there is an increased risk of invalidity. But I think also, to look at the “types” of cases being invalidated, against the backdrop of how long it took for PTO to issue guidelines on sec. 101 determinations. From these maybe reckon that we’ve still got miles ahead in rocky waters. I think its making a lot of practitioners ask themselves early on how they can write and practice to mitigate potential future adversities. What if we took say 50 the Counsel from the losing side of some of the cases, and shipped them off for a week to a luxury resort and asked them to reveal what they’d have done differently when they wrote their cases.

January 14, 2022 05:02 pmThe server immersion cooling case discussed is an excellent example of why Kathi Vidal must “prescribe regulations” to ensure that the PTAB only conducts trials that are consistent with Congressional intent behind AIA, including consideration of “the effect on the economy and the integrity of the patent system”. See 35 U.S.C §316.
The case is IPR2021-01176 Immersion Systems LLC v. Midas Green Technologies, LLC.
While the petition was properly denied, it was totally random and unpredictable. A stable and predictable analysis published in the Code of Federal Regulations would show that institution of a trial between these competitors would add cost and delay to the dispute. It would harm the integrity of the patent system by stripping the patent of its presumption of validity and increasing the likelihood of invalidation. It would directly harm the economy to impose cost, risk, and delay on a small operating company; and would indirectly harm the economy by signaling to other innovators that they should not invest in commercializing technology based on U.S. patents.
At least one other case listed also suffers from lack of regulations to govern institution. Jodi Schwendimann is a woman entrepreneur who brought her innovation to market and prevailed in enforcing her rights in a real court. Now the USPTO is destroying all of her work in order to help an large corporation steal her technology. She is the sort of small business that the AIA was supposed to protect. Due to lack of regulations, the AIA has been flipped from its purpose and is primarily used by large corporations to steal technology and block smaller competitors.
It is tragedy and it needs to be stopped.
