Impact of New Technologies in the Legal Precinct in India

Introduction:

Emerging technologies specify the new or upcoming mechanism and this plays an important role with relation to law and policy, where the government puts in efforts to bring new advancements that are efficacious to the country as whole. In the present world virtual interaction has been an essential factor of life for both the consumers and businesses and is increasing day by day with upcoming advanced technologies and individuals’ adoption to the same. Latest or not, every technology has brought an effect to society in the form of positive or negative means. Here it is easy to access every data to every individual and due to which there are a lot of issues regarding the breach or theft of the data. Technology and innovation has appeared as an integral part and has brought great influence on the economic and social evolution as it provides an easy and efficient manner of working. There is an aspect where the same is hindered by malicious intent to the data or information accessed.

Cyber warfare and Cyber terrorism:

As at present the use of the internet is becoming a vital part of the day to day life of every individual and with this there has also been an increase in cyberspace which then leads to cyber warfare. Cyber warfare in basic terms means using cyberspace or the technology to steal, disrupt or manipulate the data of the country or institution with an intention to ruin the financial or operational structures. The aim to perform such activities is mainly to harm or damage the information technology of the country with which it is at war and these may be for political or financial purposes. As the internet provides easier access and is used by a huge audience and the same would result in more browsers, who add in various information which could be professional or personal. Due to which the hackers get an easy access to one’s information which could be used against the person as a threat to leak the information or extortion. Cyber security is where the protection is provided to the data and information in cyberspace by various protection and safety measures for the network. Similar to cyber warfare there is also cyber terrorsim, which means an attack over cyberspace targeting the government for immoral objectives by infringing national security and to destroy their confidential information.

Cyber security:

The Indian legal system has brought in laws addressing the issues of cyber security. The Information technology (amendment) act, where the information technology act was amended for the purpose to add in section 66F that mentions cyber terriorism. As there were incidents of international and national cyber terriorism and to regulate the same there was punishment provided under the amended act of 2008. Then, the National computer emergency response team (CET-In), this provided in identifying, monitoring, detecting and managing the incidents. The Information technology act also under section 70B, mentions the constitution of CERT-In for maintaining cyber security and to counter the threats. Besides there is National cyber policy, that creates a system for the threats and crisis, together with National critical information infrastructure and protection centre. While the government promotes digital India for empowerment of the individuals in the area of technology and changes in technology also, changes the status of living.

Artificial intelligence(AI):

Artificial intelligence in the aspect of cyber security is one of the emerging technologies that acts as a protection from wrongful acts. Mainly artificial intelligence is where there is simulation of human intelligence processes in programmed machines and is used extensively in the present world. AI is a platform where there is a lot of data exchange. AI helps in detecting threats and provides preventive steps by giving an overview of knowledge of the world at large and formulates outcomes on the basis of the same. AI assists in analysing the data and aids to have a better understanding of the internet traffic such as account takeovers. It is a system that regulates the information technology(IT) inventory to furnish detailed records of all the users, their devices and access. Furthermore it is seen that AI allows the organisations to respond to the breach and malicious acts faster and improves the accuracy of cyber analysts.

Block chain technology:

Blockchain is a shared and digital register that records the transactions in form of blocks, which in turn helps in storing information and data persistence access to the members. Blockchain is used for improvement of security by using device to device encryption for securing communication and authentication for cyber security. It is utilised in verifying the updates for preventing malicious acts from inflicting the devices, so it protects from unauthorised access. As information and data is exchanged at a large platform and blockchain furnishes advanced security control. Therefore blockchain ensures data integrity by producing effective solutions from these attacks.

Metaverse:

Metaverse is basically a digital domain that consists of virtual and augmented reality, where individuals connect as digital avatars that are built on imagination similar to real world. This brings interaction between the legal frameworks and issues of protection of rights and infringement in the metaverse. Along with hacking and phishing here too there are security issues being faced such as scams or privacy infringement. However, metaverse raises the concerns of these issues of individuals who participate in the same or not. Cyberrsecurtiy ensures efficacy of analysing the user access and behavioural patterns and this prevents the increase in numbers of obstacles in metaverse. Moreover, initiation of web 3.0 plans to construct a pro privacy and anti-monopoly and thus solves the matter of data privacy by reducing the hacs and data breaches.

Conclusion:

It is seen that emerging technologies bring new advancement to the present situation and every individual adapts to the new technology where there is a lot of data exchange being taken place. This data is shared at a vast platform and there are individuals who have malicious intent to hamper the same, by which there is infringement of information and data. So, the laws and regulations secure the same by enforcing new rules according to the issue. The law and enforcement agencies seeks to protect the confidential data and bring cyber security so that there is reduction in the malicious act and cyber warfare or cyber terrorism. Also the individuals must be aware before agreeing to any policy of the new technologies, as they share their data on a huge platform and there are many who intend to maliciously harm the same. Moreover, in advancements such as artificial intelligence where the machine is made almost to work as a human, cyber security is a requisite factor. Data is vulnerable, in addition to which the law provides establishment of a cyber law appellate tribunal for hearing matters. Upcoming technology provides for economic as well as social advantages, however, here too the aspect of cyberspace is crucial and required. Hence, in future it would be that technology will expand to every single person from a rural area to a metropolitan city and there would be a huge exchange of data which is required to be protected.
